Conditions of Sale – 11th May 2024
Buyers Premium: The buyer’s premium at this sale is 5% & 10% plus VAT (6% & 12%) of the purchase price. VAT will be charged on the hammer price where applicable at the current rate of 20%.
Bidding: At the fall of the hammer the highest bidder shall be the purchaser but if a dispute arises as to the identity of the highest bidder the auctioneers will confirm the identity of the highest bidder or the lot will be put up again and resold. No person will be allowed to retract their bid once accepted by the auctioneers but the auctioneers reserve the right to refuse a bid from any person without giving reason.
Payments of Accounts: Payment for all lots purchased must be made in full on day of sale & methods are: Cash - To a maximum of 10,000 Sterling. Cheque - Cheques must be supported by a letter of reference from your bank or a cheque guarantee card covering the sum of your purchase. Card - Debit Card Only. For persons unknown to the Auctioneers, their lots will be impounded until the Auctioneers have cleared funds.
Disputes: In the event of a dispute between vendor & purchaser the matter can be referred to the Auctioneers whose decision is final & binding on both parties.
Commission Bids: The Auctioneers will be pleased to execute commission bids upon receipt of full written instructions but will not be liable for any errors or omissions.
Reserve Prices: The majority of the lots are unreserved and will be sold to the highest bidder. The auctioneers reserve the right to use their own discretion, acting in the interest of the vendor, for any lot to bid on behalf of the vendor and even withdraw a lot if the auctioneers so decide.
Buyers Numbers: All successful bidders must show their buyer’s number at the fall of the hammer. Buyer’s numbers are obtainable by registering with the Auctioneers.
Catalogue Descriptions, Lotting & Estimates: Whilst every care has been taken in describing the lots in the catalogue, these descriptions must not be regarded upon as fact. Intended purchasers are strongly advised to inspect and check on the availability of any particular lot upon which they intend to bid as the auctioneers act as agent only and do not have personal knowledge of the item. All lots are un-tested, without warranties or guarantees as to serviceability, working order/hours or fit for purpose and are sold ‘as seen’ unless otherwise stated. Any estimates provided are for guidance purposes only. The auctioneers reserve the right to vary the order of sale, combine or divide or withdraw any lot and to generally conduct the auction as they so decide at the time.
Responsibility of Lots: No lot will become the property of the Purchaser or may be removed from the premises until it has been paid for in full. However, at the fall of the hammer, each lot will be at the sole risk and expense of the Purchaser and the Auctioneers will not be responsible for any damage or loss that occurs due to fire, theft, accident or otherwise. With any vehicle or trailer purchased from the auction, the Purchaser is responsible for complying with all legal requirements including road worthiness of the lot and for ensuring its removal from the premises in a safe manner. A Purchaser must not attempt to disconnect any fixed electrical item without first obtaining confirmation from the Auctioneers that the mains supply has been turned off. The Purchaser is responsible for and must indemnify the Auctioneers and owner of the sale premises against any damage caused to buildings or property or any other lots at the auction. Any lot which has been sold but not removed by the Purchaser within the required time may be removed by the Auctioneers and the Purchaser will be responsible for any cost of removal and storage.
Health & Safety: Health and Safety – You are responsible for your own safety and enter the sale premises at your own risk. To help the Auctioneers protect your safety and others whilst on the sale premises, please: - Keep your driving speed to a minimum and park in the designated areas, Do not allow children to wander off on their own or climb on any of the lots, Take care around items which are trip hazards and avoid any vehicle in operation, Only stay within the areas of the premises being used by the Auctioneers, Refrain from smoking in the vicinity of the auction or near any potential fire hazard
Online bidding- Bidspotter: Allows you to view the auction live and participate in the bidding via their website. Purchasers need to register with bidspotter prior to bidding. In addition to the buyer’s premium there is an internet surcharge of 4% plus VAT (4.8%) of the hammer price.
