LOCATION AND DIRECTIONS TO THE SALE

The machinery sale ground fronts onto the A142 at Sutton, approximately 6 miles west of Ely, Cambridgeshire and approximately 18 miles North of Cambridge. The recommended approach from the North, West and South is via Huntingdon joining the A141 signposted to March at the junction of the A14/A141. At Chatteris, follow the A142 signposted to Ely and the sale ground will be seen on the left-hand side, opposite Sutton village. Access is gained from the roundabout off the A142 sign posted AGRICULTURAL AUCTION. If approaching from the East or the M11, follow the A10 and join the A142 signposted to March at Ely. Access is gained from the roundabout off the A142 sign posted AGRICULTURAL AUCTION.

A buyer’s premium at the following rates will be added to the hammer price.

(i)    In the case of overseas purchasers from EC countries will be required to supply the Auctioneers with their VAT/FISCAL NUMBER AND OTHER RELEVANT INFORMATION AS REQUESTED in order that the items may be invoiced at zero rate for VAT purposes. HOWEVER, YOU WILL BE REQUIRED TO PAY A VAT DEPOSIT EQUIVALENT TO THE STANDARD RATE OF UK VAT ON ALL LOTS SUBJECT TO VAT ON THE PURCHASE PRICE as stated in catalogue and addendum with asterisk and/or at the time of bidding. THE GOODS MUST BE SENT OR TRANSPORTED OUT OF THE UK TO A ­DESTINATION IN ANOTHER EC MEMBER STATE. It is the responsibility of overseas purchasers from EC Countries to ensure that they or their haulier complete and sign a COLLECTION CERTIFICATE on collection of the goods purchased. The original certificate must be left with the Auctioneers. Upon the above requirements being met in full, a refund of the VAT deposit will be made to the purchaser. Failure to do so will result in the VAT deposit being paid over to Customs & Excise as VAT.

(ii)   In the case of overseas purchasers from Non EC Countries, they will be required to pay a VAT deposit equivalent to the standard UK rate. Such amount will be refunded to the overseas purchaser if the Auctioneers receive, within three months of the time of supply, a satisfactory Bill of Lading or Certificate of Shipment as proof of shipment of the lots outside the EC, failing which the VAT deposit will be paid over to Customs & Excise as VAT.

 

COMMISSION BIDS

The Auctioneers are pleased to faithfully execute commission bids on behalf of Purchasers unable to attend the Sale. Such commission bids will only be accepted from persons who have viewed the Sale and completed the requisite bidding form available at the Sales Office.

 

BIDDING

People wishing to bid for specific lots should assume the rate of selling at approximately 100 lots per hour, although the sale of Motorcycles, Vehicles and Tractors will be slower.

 

BUYER’S BIDDING NUMBERS

Cheffins operate a buyer’s bidding number system. Purchasers will need to register at the sales office during the viewing day or before the sale starts. Full details of the intending Purchaser's name, address, bankers and other relevant information will be required. Failure to obtain a buyer's bidding number will result in the Auctioneer refusing to accept your bid. If you have a permanent bidding number with us, please use this number. If you are unsure please enquire in the main office on the viewing or sale day. PLEASE NOTE: There is a one-off nonrefundable administration charge of £20 (incl. VAT) for all new registrations.

 

 

DANGEROUS SUBSTANCES

Certain types of machinery could contain blue & white asbestos, dangerous chemicals and hazardous waste and, if not handled correctly during their removal, could be in breach of Health & Safety at Work 1974, Controls of Substances Hazardous to Health Regulations 1988 (COSHH) or other current regulations. The buyer undertakes to handle correctly any toxic chemicals and dangerous substances and to indemnify the agent against any failure to observe this undertaking.

 

ELECTRICAL GOODS

These are sold as ‘antiques’ only and, if bought for use, must be checked over for compliance with safety regulations by a qualified electrician first.

 

ALLā€ˆLOTS AREā€ˆSOLDā€ˆSTRICTLYā€ˆASā€ˆSEEN WITHOUT WARRANTY

Purchasers are urged to satisfy themselves prior to the sale as to the condition of each lot and whether the lot accords with its description.

 

CLEARANCE OF LOTS

Purchasers may remove their lots during or after the Sale but ONLY having first obtained a ‘pass out’ from the Office. All lots entered for sale inside must be cleared without exception on the Day of Sale. Outside lots must be cleared from the saleground by Friday 22nd July 2016. Failure by purchasers to remove their lots within this time will incur a penalty storage charge of £5 per lot per day, payable on collection. Purchasers are reminded that ALL LOTS become their responsibility at the fall of the hammer (see Conditions of Sale). Forklift loading facilities will NOT be available on the day of Sale. We will be open on Sunday 17th July 2016 from 8.00am until 12noon, after which the gates will be locked.

 

SETTLEMENT OF ACCOUNTS – PLEASE NOTE NEW BANK DETAILS

All lots must be paid for on the day of sale. Purchasers unknown to the Auctioneers and wishing to pay by cheque must make one of the following arrangements BEFORE the day of sale.

 

  1. Inform your own Bank Manager that you wish to pay by cheque, tell him the maximum amount you are likely to spend and ask him to instruct our Bankers that it will be in order to accept your cheque. The auction sale includes items of WORKING MACHINERY and those persons attending are advised to take all reasonable precautions to avoid accidents.

 

We have a duty to increase safety for both our staff and the public wherever possible and the following precautions must be adhered to by all those entering the saleground.

 

  • No lifting of machinery by forklifts, cranes, hiabs or any other means on sale day. This includes our telescopics and customers own machines.

 

  • No tractors or machinery to be left running. Vendors and Purchasers must at all times maintain supervision of machinery and vehicles whilst the engine is running.

 

  • Please keep children under supervision at all times. NO DOGS ALLOWED.

 

  • Do not drive tractors around the sale yard other than for the purposes of loading or unloading.

 

  • The speed limit in the saleground for ALL VEHICLES is 5mph. Be aware of pedestrians.

 

  • Do not smoke in the vicinity of the marquee, building, tractors or engines.

 

  • All loader arms to be lowered and contents of buckets emptied.

 

  • If starting tractors across the solenoid please ensure two people are present, one person being in the driving seat with control of the clutch and brakes, and ensuring  that the tractor is in neutral.

 

  • Prior to unloading, please check brakes, clutch and position of the engine stop.

Buyers Frequently Asked Questions

 


How can I bid at the sale?

To bid at the auction a bidder’s number is required. To obtain a bidding number complete a registration form at the sale ground. It will require a confirmation of identity, so please bring a form of photo ID i.e. passport or driver’s license. If you are VAT registered we will require your VAT number as well. There is a one off charge of £20 to complete the process. The bidding number obtained is a permanent number and can be used at all future vintage, onsite and machinery sales.

Can I do a telephone bid?

We can accept telephone bids on vehicles and higher value items only. A telephone bidding form must be completed with your name, address and contact number for the sale day. A member of Cheffins staff will contact you just prior to the lot(s) coming under the hammer and will instruct you from there. Please note that Cheffins can accept no responsibility for the telephone connection, it would therefore be wise to provide us with an alternative number. Arrangements for telephone bids will not be accepted on the day of sale. If you are a first time bidder you must supply us with proof of identity.

Can I leave a bid with the Auctioneers?

A commission bid or absentee bid can be accepted on completion of a ‘Commission Bid Form’ providing us with your name, address and telephone number and your credit/debit card details. You will need to clearly identify the lot(s) on which you wish to leave a bid with both lot number and brief description, along with the maximum amount you wish to bid excluding buyer’s premium and VAT. Cheffins will execute your bids with the remit of buying as cheaply as possible for you. The absentee bid form must be with the auctioneers no later than 9.00am on the day of sale. If you are a first time bidder you must supply us with proof of identity.

Can I bid online?

Cheffins offer a live online bidding service via i-bidder.com, currently this does not operate on all sales. This allows you to hear and see the sale in real time and carry out bidding as if you were in the sale room. To bid online you will need to register with i-bidder/bidspotter and then sign up for the separate auction you wish to bid on. It is required that you enter credit card details which are used for identification purposes and a refundable deposit of £250 will be required prior to being accepted to bid. Cheffins reserve the right to refuse any registrant from bidding.  Following a successful bid, invoices are issued in accordance with the information provided via i-bidder and Cheffins will contact you via telephone and email a copy of your invoice following the sale.  Cheffins can accept no responsibility for the internet connection.

How fast will the auctioneer sell?

Cheffins auctioneers will generally aim to sell lots at the rate of 100 per hour and vehicles at 40 lots per hour. Please note that this can vary dependent upon various factors and should not be taken as an absolute.

Is there any warranty offered with the lots?

No, all lots are sold strictly as seen. If you are contemplating a purchase of an item of any kind that is outside your personal experience we recommend that you have it examined by a suitably qualified professional prior to bidding. Cheffins will provide a catalogue description of the item to the best of our ability and based upon information supplied by the vendor. You must satisfy yourself as to the completeness and originality of the lot before bidding.

Are my purchases insured?

At the fall of the hammer the lot(s) becomes entirely your responsibility. Cheffins strongly recommends that you effect suitable insurance immediately

Can I look at relevant vehicle paperwork?

Yes, the vehicles in the sale will, where appropriate, have a suitable file containing all of the relevant documentation and keys provided by the vendor. These files are available for examination prior to the sale and we recommend you take the time to look at them thoroughly before bidding. Please note that Cheffins execute the transfer of ownership on the V5C documents, if you purchase a vehicle that has a V5C you must provide us with the relevant information of the new keeper on the day of sale that will allow us to process it with the DVLA.

Can I talk to the seller?
The vendors (seller) details are strictly confidential and will not be divulged at any time. Cheffins are happy to pass on buyers details post sale to the vendor if requested, however, it is entirely the vendor’s prerogative to reply or not.

Can I change my mind after I’ve bought a lot?

No, the contract between buyer and seller is made at the fall of the hammer, and you are bound to proceed with the contract. There are no exceptions, bid only if you are absolutely sure it is the lot you want, at a price you want.

How and when do I pay?

Payment for purchases is on the day of sale, we can accept cash up to a maximum of £7,500, debit card payment and credit card payment. Please note that a surcharge of 2% plus VAT of the invoice total if you choose to pay by credit card. You may also pay by cheque, these payments can take 5 to 7 working days to clear and you may not collect your purchases until Cheffins have cleared payment. Direct bank transfer may also be made and our account details are printed at the front of the catalogue. If you have made a purchase via telephone bid, commission bid or i-bidder.com, Cheffins will contact you immediately post sale.

What charges are there?

Cheffins charge a buyer’s premium in addition to the hammer price at the following rates:

When can I collect my purchases?

On receipt of cleared payment on the sale day, a pass-out will be issued to you and the porters will identify your lots based upon that, you will also be asked to hand this in at the security gate prior to leaving the site and your vehicle will be checked at that time. We understand that some of the larger items will need transportation organising and, by arrangement with the auctioneer, must be cleared within one working week from the date of sale. If you have made a purchase via telephone bid, commission bid or i-bidder.com, Cheffins will contact you immediately post sale to arrange for payment and collection.

Can my purchases be delivered?

Cheffins do not carry out deliveries directly, we do however, publish a list of recommended hauliers at the front of the catalogue along with contact details. Any arrangement you may make with them is entirely independent of Cheffins. Your haulier must report to the office upon collection to obtain a pass-out for your lots when he comes to collect on your behalf.

Terms & Conditions

STANDARD TERMS & CONDITIONS OF BUSINESS

1. DEFINITIONS
1.1 In these conditions the following terms have the following meanings unless inconsistent with the context:
“Auctioneers” means Cheffins of Clifton House, 1-2 Clifton Road, Cambridge CB1 7EA
“Conditions” means the standard terms and conditions of business set out in this document
“Lots” means all machinery and all other items sold or intended to be sold in accordance with these Conditions
“Purchaser” means a person, firm or company who purchases lots
“Vendor” means any person, firm or company who puts forward lots intended to be sold at the Sale
“Sale Day” means the day fixed by the Auctioneers for an auction and where the context so requires means the day fixed for the auction in which a particular lot is entered
“Reserve Price” means the minimum price fixed by either the Auctioneers or the vendor at which lots are to be sold at the Sale

1.2 Except where the context otherwise requires words denoting the singular include the plural and vice versa; words denoting one gender include all genders; words denoting persons include corporations and vice versa

2. VALUE ADDED TAX ON PURCHASE PRICE

2.1 VAT at the standard rate will be added to the purchase price of all lots. The only exceptions to this will be the case of ‘zero rated’ or ‘exempt lots’. The Auctioneers will state at the time of sale if any lots fall within these exceptions.

2.2 In the case of overseas purchasers from EC countries they will be required to supply the Auctioneers with their VAT/FISCAL NUMBER AND OTHER RELEVANT INFORMATION AS REQUESTED in order that the items may be invoiced at zero rate for VAT purposes. HOWEVER, A VAT DEPOSIT EQUIVALENT TO THE STANDARD RATE OF UK VAT WILL BE CHARGED ON ALL LOTS. THE GOODS MUST BE SENT OR TRANSPORTED OUT OF THE UK TO A DESTINATION IN ANOTHER EC MEMBER STATE.
It is the responsibility of overseas purchasers from EC Countries to ensure that they or their haulier complete and sign a COLLECTION CERTIFICATE on collection of the goods purchased. The original certificate must be left with the Auctioneers.

Upon the above requirements being met in full, a refund of the VAT deposit will be made to the purchaser. Failure to do so will result in the VAT deposit being paid over to Customs & Excise as VAT.

2.3 In the case of overseas purchasers from NON EC COUNTRIES, they will be required to pay a VAT DEPOSIT equivalent to the standard UK rate. Such amount will be refunded to the overseas purchaser if the Auctioneers receive, within three months of the time of supply, a satisfactory Bill of Lading or Certificate of Shipment as proof of shipment of the lots outside the EC, failing which the VAT deposit will be paid over to Customs & Excise as VAT.

3. RESERVE PRICE AND BIDDING
3.1 The Auctioneers and/or the vendor reserve the right to fix a Reserve Price for any lot and withdraw that lot in the event that the highest bid price does not meet the reserve
3.2 The vendor may bid for any lot either personally or through the Auctioneers or through any other person as many times as the vendor thinks fit and may withdraw any lot at any time before the sale of such lot
3.3 The Auctioneers may without giving any reason refuse to accept the bidding of any person. In the case of a dispute as to any bid, the Auctioneers may forthwith determine the dispute or put up the lot again at the last undisputed bid or withdraw the lot
3.4 No person may advance a bid less than a sum to be named from time to time by the Auctioneers nor be allowed to retract a bid
3.5 The highest bidder for each lot shall be the purchaser of that lot

4. AUCTIONEERS AS AGENT FOR VENDOR
4.1 The Auctioneers sell as Agent for the vendor and as such are not responsible for any default by the vendor or purchaser
4.2 In the event that a purchaser fails to pay the purchase price for the lot in accordance with these Conditions and the Auctioneers have previously advanced to the vendor of such lot an amount representing such purchase price the vendor shall forthwith at the request of the Auctioneers assign all and any of his rights against the purchaser in respect of the unpaid purchase price to the Auctioneers and shall execute such documents as may be required by the Auctioneers to give effect to such assignment and further, shall give reasonable co-operation to the Auctioneers in any action, claim or proceeding brought or threatened by the Auctioneers against the purchaser

5. REMOVAL OF LOTS
5.1 All lots whether sold or unsold may not be removed from the Saleground without a pass for the removal of lots. Passes can be obtained from the Auctioneers offices
5.2 All lots purchased must be cleared from the Saleground within 7 days of the date of the Sale in which they were purchased unless otherwise stated at the time of sale
5.3 The Bidder is on risk once the hammer falls and is strongly advised to effect insurance at once. Upon the fall of the hammer the Bidder shall assume all risks in and relating to such lots. The Bidder is advised to effect in respect of all such risks arising thereafter any insurance it may consider necessary. The duty of the Auctioneer and/or the vendor to deliver lots shall be deemed performed upon the fall of the hammer even if a lot is subsequently and/or part thereof has been lost

6. DETAILS OF PURCHASERS
All purchasers are required to Register before the auction at the Auctioneers Office, whether or not the lots, which they purchase are to be removed on the day of the Sale

7. EXCLUSION OF LIABILITY
The Auctioneers shall not be liable for any expense, loss, claim or proceedings in respect of personal injury to or death of any person arising out of or in the course of or caused by the Sale, except to the extent that the same is due to the negligence of the Auctioneers, their servants or agents

8. PAYMENT
All lots must be paid for on the day of the Sale by the purchaser

9. INSPECTION OF GOODS
9.1 Unless a warranty is specifically given for a particular lot at the time of the Sale all lots are sold with all faults and imperfections and errors of description. Purchasers should satisfy themselves prior to sale of the lot as to the condition of each lot and should exercise and rely on their own judgement as to whether the lot accords with its description. Neither the Auctioneers, their servants or agents are responsible for errors of description or for the genuineness or authenticity of any lot, unless otherwise stated no warranty is given by the Auctioneers, their servants or agents or by any vendor to any purchaser in respect of any lot and any express or implied conditions or warranties are excluded to the fullest extent permitted by law
9.2 The Auctioneers may at their discretion or upon the instruction of the vendor alter or withdraw all or any lots referred to in the auction catalogue up to the moment at which the hammer falls in relation to such lot(s)

10. AUCTIONEERS’ RIGHT TO ANNUL SALES
In the event of any dispute or refusal to pay or of non-payment on the part of the purchaser, the Auctioneers may, entirely at their discretion, annul and cancel the sale of such lot or lots

11. COMPLIANCE WITH ROAD TRAFFIC ACTS
The purchaser of any vehicle or trailer is responsible for complying with all legal requirements as to the construction and the use of such vehicle or trailer and for obtaining all certificates, permits or other authorisations necessary before such vehicle or trailer can be used on the road

12. HEALTH AND SAFETY AT WORK ACT 1974 AND ALL OTHER ACTS AND REGULATIONS APPLICABLE TO FARM SAFETY
The purchaser of any lots is responsible for complying with all legal requirements as to the safe use of lots purchased at the Sale and shall ensure compliance with all relevant legislation relating to the safe use of such lots

13. RESERVATION OF TITLE
13.1 If the Auctioneers allow the purchaser to remove the lot from the Saleground before the purchaser has made full payment for the lot then title to the lot shall remain vested in the vendor
13.2 If the Auctioneers pay the vendor the price of the lot before the purchaser has paid the price to the Auctioneers title to the lot shall pass from the vendor to the Auctioneers and shall remain with the Auctioneers until full payment has been made by the purchaser to the Auctioneers, when title shall pass to the purchaser
13.3 Notwithstanding that the title has not passed to the purchaser all risk of damage to the lot shall pass to the purchaser immediately upon sale (the fall of the hammer)
13.4 The purchaser shall until payment has been made in full keep the lot in good marketable condition and readily identified and shall indemnify the vendor or the Auctioneers as the case may be for any damage
13.5 In the event of any sale by the purchaser of a lot before full payment has been made the purchaser shall hold the proceeds of such sale on trust for the vendor or the Auctioneer (as the case may be) and shall pay such proceeds into a separate identifiable bank account
13.6 At any time before the title to the lot has passed to the purchaser, the vendors or the Auctioneers (as the case maybe) including the Auctioneers acting as agents for the vendor, shall have the right to enter upon the purchasers property for the purposes of recovering the lot

14. GOVERNING LAW AND JURISDICTION
For the avoidance of doubt all contracts entered into between the purchaser and vendor and between either of them and the auctioneers on the basis of these standard terms and conditions of business are governed by the laws of England and Wales and the parties hereby submit to the non-exclusive jurisdiction of the English Courts
